1. BINDING AGREEMENT & PRIORITY OF TERMS

Agreement: By accessing our website, purchasing products, joining our Loyalty Program, or booking a function or event, you agree to be bound by these Terms and Conditions. Rocky Ridge Brewing Co Pty Ltd (“RRBC”) may amend these Terms at any time without prior notice.

Priority: Where a customer has entered into a separate written Wholesale Agreement or Sponsorship Contract with RRBC, the terms of that agreement will prevail to the extent of any inconsistency.

2. LIQUOR COMPLIANCE & DELIVERY

Age Requirement: You must be 18 years or older to purchase alcohol or participate in any RRBC loyalty programs. Valid photo identification is required for all deliveries and venue entry. Loyalty membership does not constitute proof of age.

Delivery & Authority to Leave (ATL): Alcohol will not be left with minors. If you provide Authority to Leave (ATL), you accept full responsibility for the goods once marked delivered by the courier. RRBC accepts no liability for loss, theft, or damage occurring after delivery.

Refusal of Service: In accordance with Responsible Service of Alcohol (RSA) laws, RRBC reserves the right to refuse service or delivery where ID cannot be provided or the recipient appears intoxicated. No refunds will be issued in these circumstances.

3. ONLINE SALES, ERRORS & RETURNS

Pricing Errors: RRBC reserves the right to cancel and refund any order (including after confirmation) where pricing errors occur due to technical or human mistake.

Inventory: If an item becomes unavailable after purchase, RRBC may offer a suitable substitute or a full refund.

Australian Consumer Law: Our goods come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement or refund for major failure. For minor failures or change-of-mind returns, approval is at RRBC’s discretion and must be requested within 48 hours of receipt.

4. PROMOTIONS & DISCOUNTS

Exclusivity: Unless explicitly stated, promotions, discounts, and offers cannot be combined.

Application: This includes Loyalty Points, Mug Club benefits, Happy Hour pricing, and clearance items.

Discretion: RRBC reserves the right to determine which single discount applies per transaction.

5. COMPETITIONS, MARKETING & INTELLECTUAL PROPERTY

Modification: RRBC may modify, suspend, or terminate any competition or promotion at any time at its sole discretion.

User-Generated Content: By tagging RRBC or using RRBC-related hashtags on any social platform, you grant RRBC a non-exclusive, royalty-free, perpetual, worldwide licence to use your content (including photos and videos) for marketing across digital, website, email, and advertising channels. You confirm ownership or permission to share such content. Where practical, credit will be given.

Intellectual Property: All content created by or belonging to RRBC — including logos, branding, trademarks, product names, website content, imagery, copy, video, loyalty assets, and marketing materials — remains the intellectual property of RRBC and may not be reproduced, distributed, modified, or used without prior written permission. RRBC loyalty assets and benefits may be withdrawn or amended at any time.

6. LOYALTY CLUB & MUG CLUB (STORED VALUE PROGRAMS)

Eligibility: You must be 18 years or older to join. Members may hold one account only. Where multiple accounts are identified, RRBC reserves the right to merge or close accounts.

Points Mechanics:
• 1 point per $1 AUD spent
• 10 points = $1 AUD credit (current rate, subject to change)

RRBC may amend loyalty values, structures, or benefits at any time, with reasonable notice where practical.

Expiry: Points expire after 12 months of account inactivity.

No Cash Value: Points are non-transferable and cannot be redeemed for cash.

Third-Party Exclusions: Loyalty points cannot be redeemed with external vendors operating on-site or in partnership (including food vendors).

Account Closure: Members may close their account at any time by written request (email or letter). Upon closure, all accrued points are forfeited.

Mug Club: Annual fees are non-refundable. Benefits apply only to the registered member and may change without notice.

6a. ACCOUNT SECURITY, FRAUD & CHARGEBACKS

RRBC reserves the right to suspend or terminate accounts where fraudulent, suspicious, or unauthorised activity is suspected.

Customers are responsible for maintaining the security of their login details.

Any chargebacks or payment disputes may incur an administrative fee to recover processing costs. RRBC also reserves the right to recover associated third-party payment provider fees.

6b. LOYALTY PROGRAM & PROMOTIONAL MISUSE

RRBC may suspend memberships, cancel orders, revoke points, or terminate accounts without notice where misuse, abuse, or misconduct is suspected. This includes (without limitation):

  • creating multiple accounts
    • exploiting promotions
    • sharing member-only benefits
    • manipulating loyalty balances
    • supplying false or misleading information
    • theft, abusive or offensive behaviour toward staff

RRBC may reverse improperly obtained points or discounts and recover associated costs.

7. WHOLESALE TERMS

Payment: As per approved Credit Application. Late payment results in automatic Stop Credit.

Cold Chain: Wholesale customers must store RRBC products in temperature-controlled environments. RRBC is not liable for spoilage after delivery.

Title to goods remains with RRBC until paid in full.

8. FUNCTIONS & PRIVATE EVENTS

  • Bookings, Deposits & Final Payments

A 25% non-refundable deposit is required to secure any function or event booking. No areas are reserved until the deposit has been received.

Final guest numbers and the remaining balance of the function total are due no later than 7 days prior to the event date. Guest numbers provided at this time are considered final and will be used for staffing, catering, and ordering purposes.

Function quotes are valid for 30 days unless otherwise stated.

  • Minimum Spend Requirements

Certain function areas are subject to a minimum spend requirement, which will be advised at the time of booking.

Where an on-consumption food and beverage package applies, the minimum spend amount must be prepaid prior to the event and is non-refundable and non-transferable, regardless of actual consumption. Any shortfall between the minimum spend and the amount consumed is forfeited and will not be credited or refunded.

  • Exclusive Area Hire

Exclusive use of designated venue spaces (where no other patrons are present in the same area) may incur an additional room hire fee.

  • Cancellations

Written notice is required for all cancellations.

  • More than 14 days prior to event: Full refund of monies paid

  • 8–14 days prior: Deposit forfeited

  • 7 days or less prior: 100% of all deposits and prepaid amounts forfeited

Refunds outside these terms are handled on a case-by-case basis at RRBC’s discretion.

  • Responsible Service of Alcohol (RSA)

RRBC practices Responsible Service of Alcohol in accordance with Western Australian law. RRBC reserves the right to refuse service to any person who appears intoxicated or behaves in a disorderly, aggressive, or inappropriate manner. Guests may be asked to leave the premises at RRBC’s sole discretion.

Any prepaid food, beverage packages, or function costs relating to guests refused service or removed from the venue are non-refundable.

Minors are permitted only in the company of their legal guardian and must not consume alcohol on the premises.

  • Hirer Responsibilities

The Hirer is responsible for:

  • The conduct and behaviour of all guests

  • Ensuring guest safety and appropriate use of venue facilities

  • Ensuring the venue is left in a clean and undamaged condition

  • Removing all decorations and hired equipment at the conclusion of the event

  • Any damage to venue property during the hire period

  • Replacement costs for lost, broken, or missing equipment

RRBC reserves the right to charge the card on file for damages or excessive cleaning (minimum $150 for glitter/confetti or similar debris).

  • Decorations & External Items

Decorations are welcome; however confetti, glitter, balloon debris, and open-flame candles are strictly prohibited.

Outside food or beverages are not permitted unless pre-approved in writing (cakes excepted). If bringing a cake, this must be arranged in advance and clearly labelled on arrival.

  • Menus, Beverages & Availability

All prices include GST.

Menus are based on seasonal availability and RRBC reserves the right to substitute ingredients or items where necessary. Where changes occur, the Hirer will be notified and offered alternatives.

RRBC beers include limited and seasonal releases. While every effort is made to supply requested products, availability cannot be guaranteed on the event day.

Beverage packages must be booked in advance and are available for functions of 20+ guests. Bottled wines and wine-by-the-bottle products are excluded from beverage packages.

  • Allergens

Our kitchen handles products containing wheat, soy, nuts, shellfish, and other allergens. While reasonable care is taken, RRBC cannot guarantee the absence of trace allergens.

  • Venue Capacity

All functions are subject to licensed venue capacity limits.

9. PRIVACY & DATA

RRBC collects personal data to process orders and personalise experiences. By joining loyalty programs, you consent to receiving marketing via email and SMS and acknowledge use of data for targeted advertising on third-party platforms. Opt-out is available at any time.

9a. FORCE MAJEURE

RRBC is not liable for delays or failures caused by events beyond reasonable control, including extreme weather, supplier failure, government restrictions, pandemics, power outages, or staff illness.

Affected services or events may be rescheduled, credited, or refunded at RRBC’s discretion.

10. LIMITATION OF LIABILITY & GOVERNING LAW

To the extent permitted by law, RRBC’s total liability is limited to the amount paid for the relevant goods or services. RRBC is not liable for indirect or consequential loss.

These Terms are governed by the laws of Western Australia.

11. MARKETING CONSENT (EMAIL & SMS)

By providing contact details, you consent to receive RRBC marketing communications. Message frequency varies. Consent is not a condition of purchase. Standard message/data rates may apply.
